The 9th Circuit Court of Appeals will hear arguments in May over a federal judge’s decision to block the Trump administration’s phaseout of the Deferred Action for Childhood Arrivals program, according to a court filing today.
The Justice Department filed an appeal in January after a San Francisco-based federal judge temporarily blocked President Donald Trump’s decision to phase out the DACA program, which grants work permits to certain young undocumented immigrants.
The administration also petitioned the Supreme Court to intervene, but the high court rejected that request in late February, ruling instead that the case must move through the normal appeals process.
Under the terms of the Jan. 9 order from U.S. District Court Judge William Alsup, the administration is required to accept DACA renewal applications, but not to consider new enrollees to the program. In mid-February, a second federal judge in Brooklyn also blocked the DACA termination.
