Sing v. Garland - filed Sept. 17, 2024

Immigration Law Appellate review of whether an in absentia removal order is subject to recission because of exceptional circumstances was not possible where the Board of Immigration Appeals did not consider the totality of the circumstances presented in the record, and the board did not provide an adequately reasoned decision on the factors it did analyze; the petitioner did not need to substantially comply with the factors set forth in Matter of Lozada for the BIA to consider the involvement of his attorney as one of many occurrences that, together, might constitute exceptional circumstances.
