President Biden has been briefed on a plan which would end the expulsions of migrant families at the border by July 31, according to an Axios report published Sunday.
The Biden administration has been in talks with the American Civil Liberties Union (ACLU) on ending Title 42, a Trump administration policy that doesn’t allow migrants to enter the U.S. due to public health orders.
The Biden administration wants the ACLU to end their lawsuit over the Trump policy, citing that the Justice Department would have to defend the policy in court, according to Axios.
A White House official told Axios that any move will be based on “a public health decision” and will not go against anything Centers for Disease Control and Prevention (CDC) officials determine.
Title 42, which has been criticized by Democratic lawmakers and human rights advocates, has pushed back 10,000 migrant families from entering the country, leading to children being separated from families and entering the country alone.
The ACLU extended a pause on the litigation through the beginning of July, according to Axios, and White House officials feel that ending the policy on their own would carry less risk than letting it play out in court.
The U.S. has seen an influx of migrant families trying to cross the border in the past few years.
The policy has been applied less to migrant families in recent months. The Biden administration has already begun exempting families from the policy, Axios noted.
