Immigration Law The harms that an asylum-seeker and her family suffered—including murder, physical assault, kidnapping, a home invasion during which petitioner was beaten unconscious, and specific, years-long death threats—clearly rise to the level of persecution; the record evidence compelled a conclusion that the asylum-seeker experienced past persecution committed by forces that Mexican authorities are either unable or unwilling to control where she provided police with information regarding her attackers’ identities, but was told that authorities could not ensure her safety and that she should therefore flee the country.
