In the absence of an opportunity to cross-examine its declarants, the Board of Immigration Appeals erred in relying on a probation report to conclude that a petitioner had been convicted of a particularly serious crime rendering him ineligible for withholding of removal; the government deprives an individual of a fundamentally fair hearing when it fails to make a good faith effort to afford him a reasonable opportunity to confront and to cross-examine the witness against him.
