Zuniga v. Cherry Avenue Auction

The Privette doctrine does not apply to the landlord-tenant relationship between an outdoor swap operator and a vendor where there was no hiring of an independent contractor and there was no injury to an employee who was covered by workers’ compensation insurance. The presence of power lines in and of itself did not indicate obvious danger where there was evidence that most people cannot tell if overhead lines were uninsulated and energized with enough electricity to cause death.
