District judge rejects moving sanctuary lawsuit to San Francisco

A district court judged rejected a motion to move a Trump administration lawsuit against California’s sanctuary laws from Sacramento to San Francisco.

U.S. District Court Judge John Mendez denied the request by state Attorney General Xavier Becerra because he had “not adequately demonstrated that the interests of justice warrant transfer.”

“The administrative and logistical challenges that accompany transfer would likely be more burdensome than any marginal gains in efficiency,” Mendez wrote. “This court has already devoted time and resources to this case, which would need to be replicated in the [Northern District of California] following transfer.”

Becerra argued earlier this month the state of California was already involved in litigation against the federal government in San Francisco and that the Trump administration’s lawsuit should be “heard with the related case there.” Justice Department officials said the lawsuit was filed in Sacramento because it is the state capital, denying accusations they wanted to avoid liberal jurists in Los Angeles or San Francisco.

Mendez agreed the state capital was an appropriate forum for the case.

“The challenged laws apply to and affect the entirety of the state, the evidence appears to be readily accessible from either forum, and, should the case be transferred, there will be little additional burden on the United States’ witnesses and counsel in terms of travel and expense,” Mendez said.
